Filing a workers’ compensation claim can provide immediate financial relief, but the payments can be low and fail to fully compensate you for your pain and suffering. Workers’ comp claims also do not provide punitive damages, which are designed to punish employers for creating dangerous work conditions. Fortunately, you may have a legal claim outside of the workers’ compensation system that will allow you to make a full financial recovery following a workplace injury.

when can you sue outside of workers' comp for your workplace injury?

If a third party is also responsible for your injuries, you might have a claim outside of the workers' comp system. In some situations, your employer may also be held responsible. For instance you could have:
  • A product liability claim if you were injured by a defective product

  • A personal injury lawsuit against a third party that is responsible for your injuries

  • A personal injury lawsuit against your employer for intentional or egregious conduct

If you have been injured at work in California, you are entitled to payment for all medical treatment that is reasonably required to cure or relieve the injury at no cost to you. You may also be entitled to full or partial temporary disability benefits, permanent disability benefits, supplemental job displacement benefits, and, in the event of death, death benefits.

Under some circumstances, you may have a personal injury claim against another party as well. For example, a defective product used in your office may have been a contributing cause to your injury and you be able to recover compensation from the manufacturer. Or, you may have a claim against the manufacturer of a toxic substance if you were injured by a toxic substance. Your employer can even be held responsible if their actions created an unsafe work condition.
